What your car accident claim can include

California rules that decide your case
- Pure comparative negligence. You can recover even if you were partly at fault; your award is reduced by your percentage of fault.
- Two-year deadline. Most injury lawsuits must be filed within two years (CCP § 335.1). Government vehicles: a claim within six months (Gov. Code § 911.2).
- Minimum insurance went up. As of January 1, 2025, California drivers must carry at least $30,000 per person / $60,000 per accident / $15,000 property damage. Many policies are still too small for a serious injury, which is why we look at every policy that could apply, including your own UM/UIM coverage.
- Prop 213. If you were driving without insurance, California limits you to economic damages (bills and wages) in most cases. Call us anyway. There are exceptions, and your economic damages still matter.
